For all of the homeless people in Martin County, hundreds of people have to commit a crime in order to go to sleep every single night. House Bill 1365, which is now one of the Florida statutes, pretty much saying that you cannot sleep in public anymore. That is illegal.You also know that it is illegal to trespass or sleep in the woods. There are no shelter beds available, period. There's no shelters, and there's no designated camping area.Tonight, I have to commit a crime, and I'm going to commit a crime. This is an actual civil rights crisis. My name is Todd Katukas, and I have a federal active lawsuit against Martin County, the Martin County Sheriff's Office, and a particular sergeant from the Martin County Sheriff's Office.The case number is ---------. You can track the lawsuit on PACER.gov. I am my own attorney in this case, which means I'm pro se. I don't have a lawyer.There was a house bill passed last year. Which one was it? House Bill 1365, which is now one of the Florida statutes. I have it somewhere above, but I'm not going to dig it up.Pretty much saying that you cannot sleep in public anymore. There are no shelter beds available, there's no shelters, and there's no designated camping area as the House Bill 1365 suggests that there should be.I'm not going to go too much into the details of the lawsuit, but basically, there are a few constitutional amendments being infringed upon, not just by me, but by hundreds of Martin County residents. One of them being the right to travel, which is part of the U.S. Constitution. That is a protected right from the U.S. Constitution, and also as well the Florida Constitution.Now, it kind of makes me mad how this is not seen as the civil rights emergency in which it is. This is an actual civil rights crisis. I have emailed the commissioners about this, so now that they are fully informed, even though they probably were before, as far as the status of this lawsuit, the federal judge has waived my fees, so she has given it the green light.She understands fully what's going on. I submitted the lawsuit and four copies to go to each of the defendants, to the U.S. marshals. That was about 33 days ago, and the marshals still have not served the defendants, so I am just letting you know because I want full transparency, and the more people that know about this is the better.(4:07 - 4:32)
Now, let's set the record straight. I do not hate police. I do not hate Martin County.I do not hate the Martin County commissioners. I actually like the Martin County commissioners. Let me put this into perspective. My friend, a good friend of mine, and his fiance or wife, I'm not sure. They had a beautiful camp.They had a nice big tent with a big, I think it was like a king-size mattress in there, and they had a generator going, a very clean camp, very well maintained and all of that, and they got trespassed when the officers obviously knew that there was no legal alternative for them to go or anywhere legal for them to go, so basically you just have to find somewhere else to trespass, and in the process of them transitioning their things, she had gotten an electric bike from somebody for Christmas. It was around $500, and in the process of transitioning and relocating her things, her bike got stolen. Now, I'm just using this example to put this into perspective now times this by 100.We're not going to even go into the losses that I have went through that are stated in this lawsuit, and by the way, the case number is ---------. There is still no designated camping area, and there is still no shelter open, and we still have to commit a crime tonight and the next night and the next night and the next night and the next night. This is a problem, and all of the people that don't have a house to sleep in in America that are in similar circumstances need to stand up, man, and this is about to turn to a class action lawsuit simply because of appeared maliciousness of all of the defendants for knowing that we have no legal alternative, but still enforcing this and still not amending the law in some way or anything like that.(9:51 - 10:03)
